PekiTime Terms of Service

PekiTime is software for recording and organizing time-related information. PekiTime for Solo Pros is designed for freelancers and solo business owners. PekiTime for Homeschoolers helps Account Owners and eligible Student Users record homeschool time and course information.

You are responsible for accurate account information, protecting your login credentials and email account, and the information entered into your account. The Account Owner is also responsible for permitted users invited under the account.

For Homeschool accounts, independent Student User login access is limited to students age 13 or older. By inviting a Student User, the Account Owner represents that the student is at least 13 and that the Account Owner is the student's parent or legal guardian. Students under 13 may have records managed by the Account Owner but may not have independent login access.

PekiTime currently offers an Annual Plan for $29.99 per year and Lifetime Access for $89.99 one time. Eligible accounts may also receive one 14-day Free Trial without a credit card. A Free Trial is not required before purchase.

The Annual Plan renews automatically each year unless renewal is turned off before the renewal date. Turning renewal off does not end paid access immediately; access continues through the Paid-Through Date. Users may manage billing, payment information, invoices, cancellation, and renewal through the Stripe Billing Portal available from PekiTime Settings.

Payments are processed by Stripe on behalf of Blu Dove Designs, LLC. Charges for PekiTime may appear as "Blu Dove Designs" on your credit or debit card statement.

If an Annual renewal payment fails, Stripe may retry the payment and send billing notifications or instructions for updating the payment method. PekiTime may treat the account as past due and may expire access if payment is not recovered.

Prices may change for future purchases or renewals. A price change will not retroactively change the price of a completed Lifetime Access purchase.

Lifetime Access is a one-time purchase providing access to the purchased PekiTime product for as long as that product remains offered by Blu Dove Designs, LLC, subject to these Terms. It does not require Blu Dove Designs, LLC to operate PekiTime indefinitely or preserve every feature forever.

An eligible Annual Plan user may upgrade to Lifetime Access. Under the current upgrade policy, the most recent $29.99 Annual payment is credited toward the $89.99 Lifetime price, making the upgrade $60 one time. Earlier Annual payments do not accumulate. When the upgrade is successfully completed, the associated Annual subscription is cancelled and Lifetime Access is granted.

PekiTime may offer promotional or discount codes. A promotion may reduce or waive the amount due, including reducing a purchase to $0, but does not change the underlying plan terms unless expressly stated.

PekiTime is digital software. All Annual Plan, Lifetime Access, and Lifetime Upgrade purchases are final and non-refundable except where required by applicable law. Turning off renewal, Account Expiration, or Account Deletion does not create a refund or credit for unused time or Lifetime Access.

When a Free Trial or Annual Plan ends without renewal or another paid plan, access may expire. Expiration is not deletion. PekiTime may retain the account and its data so the Account Owner can later reactivate access, subject to the Privacy Policy and applicable retention practices.

The Account Owner may permanently delete the account through PekiTime Settings. For an Annual Plan, deletion immediately ends access and requires cancellation of the active Stripe subscription. If the subscription cannot be successfully cancelled, deletion stops rather than falsely reporting success. No refund or credit is provided for unused Annual time.

Deleting an account with Lifetime Access permanently relinquishes that Lifetime entitlement. Returning after deletion requires a new purchase. Account Deletion is permanent, subject to limited backup, transaction, legal, fraud-prevention, or security retention described in the Privacy Policy and applicable third-party retention requirements.

You retain ownership of content you provide to PekiTime, including business logos, client names, student and course information, activity descriptions, and time entries. You grant Blu Dove Designs, LLC a limited license to host, store, process, display, reproduce, and transmit that content only as reasonably necessary to operate, secure, support, and provide PekiTime.

You warrant that any logo, image, text, name, or other material you provide is owned by you, properly licensed to you, or otherwise lawfully used. You are responsible for obtaining required permissions and agree to indemnify and hold harmless Blu Dove Designs, LLC from claims arising from materials you provide that infringe or violate another party's rights.

PekiTime, including its software, branding, interfaces, original content, workflows, and related intellectual property, is owned by or licensed to Blu Dove Designs, LLC. Your account provides a limited, non-exclusive, non-transferable right to use PekiTime for its intended purpose while entitled to access.

You may not copy, resell, sublicense, reverse engineer, interfere with, or exploit PekiTime without prior written permission from Blu Dove Designs, LLC, except as permitted by applicable law.

You may not use PekiTime for unlawful, fraudulent, abusive, or infringing purposes; attempt unauthorized access; disrupt or overload the service; upload malicious code; or violate another person's privacy, intellectual-property rights, or other legal rights.

PekiTime provides tools for recording and organizing information supplied by users. You are responsible for reviewing entries and reports for accuracy and completeness.

PekiTime is not a payroll, accounting, tax, legal, accreditation, or regulatory-compliance service and does not guarantee that its records satisfy tax, accounting, payroll, legal, regulatory, reimbursement, licensing, educational, scholarship, transcript, or recordkeeping requirements.

For PekiTime for Homeschoolers, Account Owners remain responsible for determining whether their records, courses, instructional hours, credits, transcripts, scholarship or PEP reimbursement documentation, or other homeschool materials meet requirements applicable to their family, school, program, or jurisdiction.

Blu Dove Designs, LLC works to keep PekiTime available and functioning but does not guarantee uninterrupted or error-free service. Maintenance, updates, infrastructure failures, security events, third-party outages, internet disruptions, or events beyond our reasonable control may affect availability.

PekiTime may add, remove, improve, or change features over time and may modify or discontinue a PekiTime product when reasonably necessary. Where appropriate, notice will be provided of material changes that significantly affect paid access.

To the fullest extent permitted by law, PekiTime is provided "as is" and "as available." Blu Dove Designs, LLC does not guarantee that PekiTime will be uninterrupted, completely error-free, or suitable for every particular purpose or legal requirement.

To the fullest extent permitted by law, Blu Dove Designs, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost business opportunities, loss of data, or similar losses arising from PekiTime.

To the fullest extent permitted by law, Blu Dove Designs, LLC's total liability arising from PekiTime will not exceed the amount you paid for PekiTime during the twelve months preceding the event giving rise to the claim, or, for a Lifetime Access claim arising more than twelve months after purchase, the amount paid for that Lifetime Access. These limitations do not apply where prohibited by law.

These Terms are governed by Florida law. Before filing a formal claim, you agree to contact Blu Dove Designs, LLC in writing and make a good-faith effort to resolve the dispute directly.

Except where prohibited by law or where a claim qualifies for small-claims court, disputes arising from these Terms or PekiTime will be resolved by binding, individual arbitration rather than a jury trial or class action. You and Blu Dove Designs, LLC waive participation in class actions or class-wide arbitration to the extent permitted by law.

Any permitted court proceeding will be brought in a court of competent jurisdiction in Alachua County, Florida, unless applicable law requires otherwise. Each party is responsible for its own attorneys' fees and costs unless applicable law, an arbitration award, or a court order provides otherwise.

Blu Dove Designs, LLC may update these Terms as PekiTime or applicable requirements change. The “Last updated” date will be revised when changes are made, and additional notice will be provided for material changes when required by law. Continued use after updated Terms take effect constitutes acceptance except where applicable law requires another form of consent.

Changes to these Terms do not retroactively alter a completed Lifetime Access purchase price or create recurring subscription charges for a Lifetime Access purchase.
